Lone dissenter in the Civil Rights Cases - 1883, and Plessy v. Ferguson - 1896, which, respectively, struck down as unconstitutional federal anti-discrimination legislation and upheld Southern segregation statutes. In Pace v. Alabama - 1883 he supported opinion that anti-miscegenation laws are constitutional.                                              
Born into a Kentucky slaveholding family whose presence in the region dated back to 1779.

Member of the Whig Party which was destroyed by the question of whether to allow the expansion of slavery to the territories, in 1856.

Abraham Lincoln was also a member of the Whig Party, 1832–1854, then the Republican Party, 1854–1865.
